Arrest Related Deaths Information

Overview - Since 2003, Missouri Statistical Analysis Center have assisted the Bureau of Justice Statistics (BJS) compile information about deaths occurring during the process of arrest or in the presence of state and local law enforcement officers. This program is a component of the BJS Deaths in Custody Reporting Program. This program requires the reporting of certain data on deaths of persons in the custody of law enforcement agencies, and deaths which result from lethal force by law enforcement officers.

The definition of the deaths at issue is: A death of any person in the physical custody, or under the physical restraint of law enforcement officers, regardless if the person was not under arrest at the time of death. A qualifying ARD death includes those persons under physical restraint or custody as well as those that are not directly related to police actions or negligence such as deaths attributed to intoxication, suicide, accidental injury, and illness / natural causes. Further refinement of this definition is presented below. This reporting system is intended to complement another federal system that requires reporting on persons who die during incarceration, either in jails or prisons.

Included and Excluded Deaths - For cases which appear to be on the fringe of the definition given, some further guidelines for reporting are these:

Include deaths of persons arrested or subject to arrest who die:

From any cause while in the physical custody or physical or practical restraint of law enforcement officers (even if no arrest has yet occurred); From any cause while in the physical custody or physical or practical restraint of law enforcement officers (even if no arrest has yet occurred); At a crime scene, in transit, in a booking or intake center, or medical facility, or in a police lock-up or jail prior to arraignment; As a result of lethal force by officers.

Exclude deaths:

Which result from accidents, suicides or natural causes prior to being placed in custody or physical restraint, or prior to the use of force by officers; Of persons in formal locked confinement after arraignment (jail, detention center or prison); Of persons not intended to be arrested (bystanders, etc.).

Forms

Quarterly Summary of Deaths in Law Enforcement Custody:

The CJ-11 form is used by SAC for quarterly or annual summaries of the number of arrest-related deaths.



Law Enforcement Custodial Death Report Form:

(Use this form if your agency has any death in custody to report)


The CJ-11A is a form that is completed for each identified arrest-related death using information from official source documents.
